1 Services Offered

Santi’s Fountains provides the following products and services to residential and commercial customers in Southern California:

• Sale of decorative concrete and stone fountains, including wall, pond, and free-standing styles
• Fountain installation and delivery
• Fountain releveling and repair
• Fountain cleaning and maintenance
• Pump replacement and repair
• Custom color changes and finishing
• Custom concrete tables and outdoor furniture

All services are subject to availability, scheduling, and the specific terms agreed upon at the time of purchase or booking.

2 Quotes and Estimates

All quotes, estimates, and free consultations provided by Santi’s Fountains — whether in person, by phone, or via our website contact form — are non-binding estimates only. Final pricing may vary based on site conditions, materials, labor requirements, product availability, and other factors identified at the time of service.

A written quote provided by Santi’s Fountains will remain valid for 30 days from the date of issue unless otherwise stated in writing.

3 Pricing and Payment

All prices are listed in U.S. dollars and are subject to applicable California state and local sales tax. Prices are subject to change without notice until a purchase order or invoice is issued and accepted by the Customer.

We accept the following forms of payment:

• Cash
• Check (made payable to Santi’s Fountains)
• Major credit and debit cards

Full payment or a deposit as agreed may be required prior to delivery, installation, or commencement of services. Returned checks are subject to a returned check fee in accordance with California law.

4 Orders and Deposits

Custom orders, special orders, and certain in-stock purchases may require a non-refundable deposit of up to 50% of the total purchase price. The deposit amount will be communicated to you prior to confirmation of your order.

Orders are not confirmed until a deposit has been received and a confirmation has been provided by Santi’s Fountains. We reserve the right to decline any order at our discretion.

5 Delivery and Installation

Delivery and installation services are available within our designated service area in Southern California. Delivery fees, if applicable, will be disclosed at the time of purchase.

Scheduled delivery and installation dates are estimated and may be affected by weather, product availability, or other circumstances beyond our control. We will make reasonable efforts to notify you of any delays.

Customer must ensure that the installation site is accessible, clear of obstructions, and meets the requirements communicated by our team prior to the installation date. Failure to do so may result in rescheduling fees or additional charges.

6 Customer Responsibilities

By purchasing products or services from Santi’s Fountains, you agree to:

• Provide accurate and complete information when placing orders or requesting services
• Ensure the installation site is prepared, accessible, and safe for our team prior to the scheduled service date
• Obtain any necessary permits or HOA approvals required for fountain installation on your property
• Follow all care and maintenance instructions provided with your product
• Notify us promptly of any issues with products or services received

7 Limited Warranty

Santi’s Fountains warrants its workmanship on installation and repair services against defects for a period of 90 days from the date of service completion, under normal use and conditions. This warranty does not cover damage resulting from misuse, neglect, improper maintenance, vandalism, acts of nature, or modifications made by third parties.

Products sold by Santi’s Fountains may carry their own manufacturer’s warranty, which will be disclosed at the time of purchase. We make no additional warranties beyond those provided by the manufacturer.

ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

8 Returns, Cancellations, and Refunds

In-Stock Products: Unused, undamaged in-stock items may be returned within 14 days of purchase with original receipt for a refund or exchange. Items must be in original condition. A restocking fee of up to 15% may apply.

Custom and Special Orders: All custom orders, special orders, and made-to-order items are final sale and are not eligible for return or refund once production has begun.

Service Cancellations: Cancellations of scheduled services must be made at least 48 hours prior to the scheduled appointment. Cancellations made with less than 48 hours’ notice may forfeit any deposit paid and may be subject to a cancellation fee.

Refunds, where applicable, will be processed within 10–14 business days using the original payment method.

9 Limitation of Liability

To the fullest extent permitted by applicable law, Santi’s Fountains shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, property damage, or personal injury arising out of or related to your use of our products or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or our products and services shall not exceed the total amount paid by you to Santi’s Fountains for the specific product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10 Intellectual Property

All content on the Santi’s Fountains website, including but not limited to text, images, photographs, graphics, logos, and design elements, is the property of Santi’s Fountains or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or use any content from our website without our prior written permission.

11 Website Use

Our website is provided for informational and transactional purposes only. You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website.

We reserve the right to modify, suspend, or discontinue the website or any portion thereof at any time without notice. We are not liable for any loss or damage caused by unavailability of the website.

12 Privacy Policy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our website or services, you consent to the practices described in our Privacy Policy.

13 Indemnification

You agree to indemnify, defend, and hold harmless Santi’s Fountains, its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your breach of these Terms, your use of our products or services, or your violation of any applicable law or third-party rights.

14 Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them or our products and services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California. You consent to personal jurisdiction in such courts.

Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute in good faith through direct communication for a period of at least 30 days.

15 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions.

16 Changes to These Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The “Last Updated” date at the top of this page indicates when these Terms were most recently revised.

17 Entire Agreement

These Terms, together with our Privacy Policy and any written agreements or invoices provided at the time of purchase, constitute the entire agreement between you and Santi’s Fountains regarding your use of our website and services, and supersede all prior agreements or understandings, whether written or oral.
